Terms of Use

These Terms govern access to and use of The Hoard. By creating an account or using the service, you agree to these Terms and the Community & Marketplace Rules. Mandatory consumer rights remain unaffected.

1. The service

The Hoard provides marketplace and workflow tools for discovering artists and YCHs, publishing listings, maintaining portfolios and character references, communicating, managing commission orders and using optional premium platform features.

2. Accounts and security

You are responsible for maintaining control of your account and for activity performed through it. Use accurate account information where required, protect passwords and MFA credentials, and notify The Hoard through the official support channel if you believe the account has been compromised.

Collector is the default role. Artist mode is an optional seller role and requires an accepted MFA method plus acknowledgement of the Community & Marketplace Rules. Staff access is subject to stronger security requirements.

3. Marketplace role and artwork payments

The Hoard is not the payment service provider, escrow agent or merchant of record for artwork sold by artists through their own payment methods. Artists choose their external payment providers and buyers pay those providers directly. The Hoard may record order state, selected method and payment-status references to support the workflow.

Each artist is responsible for their own offer, commission terms, delivery obligations, taxes and payment-provider relationship. Buyers are responsible for reviewing the listing and artist terms before committing.

4. The Hoard's paid services

The Hoard itself may charge for optional services such as Artist Pro, Collector Pro and Featured YCH promotion. The current price, currency, billing cadence and features are shown before checkout. Platform payments are processed through PayPal or another provider explicitly presented by The Hoard.

Pro subscriptions are recurring when sold as a recurring plan. Cancelling stops future renewal; unless a refund, reversal or suspension applies, access normally continues until the end of the already-paid billing period. Featured YCH boosts are one-time promotional services for the selected duration and do not renew automatically.

Promotional placement does not guarantee views, clicks, bids, commissions or sales. A Featured label identifies paid placement to users.

5. Consumer cancellation and withdrawal rights

Nothing in these Terms removes rights that consumers cannot legally waive. Where a statutory withdrawal period applies to a The Hoard purchase, users may exercise that right through the official support channel. If the user asks for a paid digital service to begin during an applicable withdrawal period, any legally required consent, acknowledgement, proportionate charge or exception will apply according to mandatory law.

Payment-provider disputes and chargebacks do not automatically resolve the underlying account state; The Hoard may suspend the associated premium entitlement while a payment is reversed, disputed or unpaid.

6. Listings, orders and artist-client agreements

Artists must describe listings honestly, including material restrictions, pricing, sale format, slots and expected delivery information. Buyers must provide truthful payment and reference information. The order workspace records the parties' workflow but does not replace clearly stated artist commission terms.

The Hoard cannot guarantee that an artist or buyer will complete a transaction. Where a dispute cannot be resolved between participants, users may open a private support ticket. Any refund of artwork payment may still need to be handled through the artist's payment provider.

For YCH auctions, the winning bidder must give a clear sign of life in the order workflow within 72 hours after the winning order is created, for example by messaging the artist or starting the payment process. If no buyer action is recorded during that period, the winning allocation may be cancelled automatically and offered to the next eligible bidder at that bidder's own highest bid. If no eligible runner-up exists, the auction ends without a buyer.

7. User content and intellectual property

You retain the rights you hold in content you upload. You grant The Hoard a limited, non-exclusive licence to host, store, reproduce, resize, transmit and display that content only as reasonably necessary to operate the features you choose, such as listings, portfolios, public profiles, private order references and backups.

You must have the rights or permission necessary to upload and publish content. The Hoard may remove or restrict content when required by the Community Rules, applicable law, a valid rights complaint or platform-security needs.

8. Public content, ratings and moderation

Public material must comply with the selected SFW, Suggestive or NSFW rating and the Community & Marketplace Rules. In particular, sexual or sexually suggestive content involving characters depicted or presented as underage must not be published on public-facing areas of The Hoard.

The Hoard may correct ratings, limit visibility, remove public content, revoke promotions, restrict seller features, suspend accounts or terminate accounts when reasonably necessary to enforce the rules, protect users or comply with law. Users may challenge moderation decisions through the official Discord ticket system.

9. Reviews, rankings and promotions

Reviews can only be submitted by the buyer after the related order reaches a delivered or completed state, and each order can be reviewed once. Search and discovery can use listing metadata, freshness, user-selected sorting, engagement and clearly identified Featured placement. Users must not manipulate reviews, tags, engagement or ranking signals in bad faith.

10. Availability and changes

The Hoard may add, change, suspend or discontinue features, particularly while the platform is evolving. Reasonable efforts are made to preserve active order and billing records during changes, but uninterrupted availability is not guaranteed. Users should keep their own copies of final commissioned artwork and important transaction records.

11. Liability

To the maximum extent permitted by applicable law, The Hoard is not responsible for the quality, legality, delivery or payment performance of artwork transactions concluded directly between users and artist-selected payment providers. Nothing in these Terms excludes liability that cannot legally be excluded or limited.

12. Support and notices

General support is provided only through private tickets on the official The Hoard Discord listed at /support. Do not send passwords, MFA codes or recovery codes. Legal and privacy contact information is listed separately on the Imprint.

13. Changes to the Terms

These Terms may be updated when the service, pricing, policies or legal obligations change. Material changes will be communicated where appropriate. Continued use after an updated version takes effect is subject to applicable law and the revised Terms.
